EchoEvolve provides AI-powered local market intelligence and competitor analysis tools for businesses. Our services include:

• Free Competitor Reports: Basic competitor ranking analysis with up to 8 competitors
• Premium Reports ($49 one-time): Comprehensive analysis with up to 20 competitors, AI-powered recommendations, historical trend analysis, and 90-day growth roadmap
• Dashboard Access (subscription plans): Ongoing monitoring, multi-location management, and real-time competitor tracking

3. Account Registration and Security

3.1 Account Creation

To access certain features of the Service, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3.2 Account Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age.

4. Payment Terms

4.1 Pricing

Current pricing for our services:

• Free Report: $0 - Basic competitor analysis
• Premium Report: $49 USD (one-time payment) - Comprehensive analysis with advanced features
• Subscription Plans: Pricing displayed on our website at the time of purchase

All prices are in U.S. Dollars (USD) unless otherwise stated. We reserve the right to change our pricing at any time, but price changes will not affect orders already placed.

4.2 Payment Processing

Payments are processed securely through Paddle (Paddle.com Market Limited). By making a purchase, you agree to Paddle's terms and conditions. We do not store your payment card information.

4.3 Taxes

You are responsible for paying all applicable taxes associated with your purchase. Paddle, as our Merchant of Record, will calculate and collect applicable taxes (VAT, sales tax, etc.) based on your location.

4.4 Subscription Billing

For subscription services:

• You will be billed automatically on a recurring basis (monthly or annually as selected)
• Your subscription will automatically renew unless you cancel before the renewal date
• You can cancel your subscription at any time through your account dashboard
• Cancellation takes effect at the end of the current billing period

5. Refund Policy

5.1 Premium Reports

We offer a 7-day money-back guarantee on all Premium Report purchases. If you are not satisfied with your Premium Report, contact us at support@echoevolve.com within 7 days of purchase for a full refund.

5.2 Subscription Services

Subscription refunds are handled on a case-by-case basis. We do not provide refunds for partial subscription periods, but you may cancel at any time to prevent future charges.

5.3 Refund Processing

Approved refunds are processed within 5-7 business days and will be credited to your original payment method.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Transmit any harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the Service or servers
• Use automated means (bots, scrapers) to access the Service without our express written permission
• Resell, redistribute, or sublicense our Service without authorization
• Use the Service for competitive analysis of EchoEvolve itself

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, software, and data compilations, are the exclusive property of EchoEvolve or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain ownership of any content you submit to the Service (business information, feedback, etc.). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content solely for the purpose of providing and improving the Service.

7.3 Reports

Reports generated by our Service are provided for your personal or business use. You may not resell or redistribute these reports without our express written permission.

8. Data Privacy and Security

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• Google Places API (for competitor data)
• Paddle (for payment processing)
• Email service providers
• AI services (for recommendations)

Your use of these third-party services is subject to their respective terms and conditions. We are not responsible for the actions, content, or policies of third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will meet your specific requirements
• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Any errors in the Service will be corrected

The data provided in our reports is sourced from publicly available information (primarily Google Places API). We strive for accuracy but cannot guarantee the completeness or accuracy of third-party data.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ECHOEVOLVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless EchoEvolve, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you submit to the Service

13. Modifications to Service and Terms

13.1 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

14. Termination

14.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.

14.3 Effect of Termination

Upon termination:

• Your right to use the Service will cease immediately
• We may delete your account and data in accordance with our data retention policies
• Sections of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability

15. Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Egypt, without regard to its conflict of law provisions.

15.2 Jurisdiction

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Cairo, Egypt.

15.3 Informal Resolution

Before filing a claim, you agree to contact us at legal@echoevolve.com to attempt to resolve the dispute informally.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and EchoEvolve regarding the Service and supersede all prior agreements.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

16.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
